Five Steps to Qualify for Benefit Eligibility

Step One: You can’t be working or engaging in Substantial Gainful Activity (SGA). The maximum SGA for 2021 is $1310 “gross.”

Step Two: You must have a severe impairment.

Step Three: Your impairment must meet or equal a condition that the Social Security Administration (SSA) has agreed is disabling. Examples of this type of condition are Lou Gherig’s disease, epilepsy, cystic fibrosis, lupus, AIDS and many cancers. If so, then you may be entitled to benefits just based on your diagnosis alone.

Step Four: If your impairment does not meet or equal a step three condition then the SSA looks at the last 15 years of your work history to determine whether, based on the restrictions and limitations you receive from your doctor, you have the physical or mental ability to return to doing any of the work you have done in the past; if not,

Step Five:  The SSA looks to see if there any job out there that will accommodate your restrictions and limitations? It doesn’t matter if the potential employer is hiring or not, but whether or not there are jobs that exist that will accommodate your restrictions and limitations.
